We all want to be able to make our own decisions about our lives, but sometimes life doesn’t work out as planned. I can help you prepare for the worst case scenario, should you find yourself unable to make your own decisions, whether about your finances or your own personal welfare.

GUARDIANSHIP ORDERS UNDER THE ADULTS WITH INCAPACITY (SCOTLAND) ACT 2000
Depending on the nature of the Guardianship Order sought, assistance under the Scottish Legal Aid Scheme may be available either because the Adult themselves is financially eligible, or on a non-means-tested basis. Where the Order proposed includes either welfare powers only, or welfare and financial powers together, Civil Legal Aid will be available, and will cover both our time and the costs of the statutory reports required.
If the Adult is eligible for Legal Advice and Assistance, the work required to make and lodge the application for legal aid will be covered by a grant of Legal Advice and Assistance.
If the Adult is not eligible for Legal Advice and Assistance, the fee for preparing and submitting the application for Civil Legal Aid will be £300.
Where the Guardianship Order sought relates solely to financial powers, our hourly rate of £180 per hour will apply for all work carried out.
The number of hours spent on your case will be determined by the complexity and the unique circumstances of your case. We will discuss the likely cost of your case with you at our initial meeting. If additional costs arise due to unforeseen circumstances, we will discuss this with you at the earliest opportunity and we will advise you of any increase in cost that may arise.
Please note, the hourly rate does not include any outlays that may be required. These are variable depending on the nature of the case. We will discuss what these may be at our initial meeting. Examples include:
-
The costs of the statutory reports to be submitted with the application
-
Court fees associated with lodging the application
-
Registration fees for registering the Guardianship Order with the Office of the Public Guardian
PRICING
For those who haven’t got a Power of Attorney in place, and who aren’t able to make their own decisions, whether because of a lifelong condition, or a sudden accident or illness, someone else might need to step in to make those decisions for them. If that’s you, you will need to make an application to have yourself appointed as Guardian. A Guardianship Order needs to be granted by the Court, and I can help you through the process, from start to finish, even including accessing funding in certain cases.

Apart from making our own decisions in life, we also want to make our decisions about what happens to our belongings and savings when we die. The only way to ensure that your wishes will be followed is by writing a Will. I can help you turn your wishes into your Will, and make sure you’re aware of any potential issues from your circumstances.
